Terms and Conditions of Sale

  1. Order Placing in General

You can place an order by emailing us at info@thesurgeonshands.com or on our website: www.TheSurgeonsHands.com or at our Ebay store (Search User: “SurgeonsHands”). Additionally, our products may be available through various companies’ sales representatives.

  1. Orders by Email

If you would like to place an order by email, we can bill you via Paypal link. All you have to do is email us with the following information:

  • Your full name
  • Shipping Address
  • Shipping Instructions
  • Product(s) Desired
  • Quantity

Once we have your information, we can bill you via Paypal, and you will provide Paypal with your payment information. DO NOT send us your credit card number. That information is for Paypal, which is a renowned payment service provider.

  1. Taxes

Paypal will calculate your tax information, and the tax you owe will be reflected as you proceed with your transaction.

  1. Shipping

We charge a $10.00 flat rate for shipping in the continental US. If you would like to have your product ships elsewhere, we can work that out as well. Please email us at: info@thesurgeonshands.com.

  1. Payment Terms

Payments, including tax and shipping, will be due at the time you order through Paypal.

  1. Prices May Change Without Notice

At Surgeon’s Hands, our prices are not a unilateral contract that binds us by a surgeon’s performance (payment). Instead, the price offerings constitute an invitation to offer. This is typical for a company such as ours, but we must clarify this point to cover our bases.

  1. Limited Warranty

Surgeon’s Hands warrants that its products will be free from defects in workmanship and materials for ninety (30) days from the date of payment or initial invoice, whichever comes first. The warranty is valid so long as a customer/surgeon uses the instrument as intended. In the event a product is defective in material or workmanship, you must return the product to Surgeon’s Hands so that we can study the issue and take steps to ensure it doesn’t reoccur. Additionally, upon receiving the product, Surgeon’s Hands will provide you with one of the following remedies:

(a) give you a full refund;
(b) give you a full store credit; or
(c) replace the product.

The express warranty we just set forth in this section, Section 7, is the only warranty made by Surgeon’s Hands. Surgeon’s Hands disclaims any other warranties of any kind or description whatsoever, whether express or implied, including warranties of merchantability or fitness for a particular purpose. We also disclaim implied warranties which might arise through a course of dealing or course of performance, including all, but not limited to, those described Under Section 1-303 of the Uniform Commercial Code.

  1. Returns Policy

Surgeon’s Hands makes the highest quality products possible by the highest skilled American tradesmen. Our products are proudly MADE IN THE USA. We want you to be completely satisfied with your purchase. If this means you’d like to return your product, we ask that you contact us at info@thesurgeonshands.com prior to returning your goods. Below is a list of how we will proceed through the returns process:

  • Return Information. We must know who bought the product and how it ended up being shipped back to our store. As you can imagine, if products just showed up at our doorstep, it would be difficult to manage. Hence, customers/surgeons must provide us with their name, shipping address, date of purchase, and product(s) purchased, as well as which products the customer wishes to return. This notice can be fulfilled through a simple email to: info@thesurgeonshands.com. After we know who you are and what product is coming back to us, we can proceed with the return process.
  • Return Authorization. We require notice regarding your plan to return. We retain the right not to accept products that have been damaged or compromised if there was no defect in design or workmanship. Surgeon’s Hands will issue a refund for the returned product to the customer/surgeon’s method of payment once Surgeon’s Hands receives the returned item and processes it. Surgeon’s Hands is unable to refund postage costs for returns. Returns are not subject to a restocking charge.
  • Standard Returns. If your product has been purchased in the last ninety (30) days, we will accept your return, assuming there is a defect in material or workmanship, if you provide us with notice within that 30-day period. If it’s been longer than ninety (30) days, or you have another reason for returning the product, you must contact us via email, and we will make a determination on a case-by-case basis.   • Warranty Claims. As stated above, prior authorization is required for products returned for reasons of breach of warranty. Surgeon’s Hands reserves the right not to authorize returns for a product after the expiration of the ninety (30) day warranty period. Refunds or replacements will be processed under Section 7 of these terms and conditions.
  • Return Policy Amendments. Surgeon’s Hands reserves the right to amend its Terms and Conditions. Surgeon’s Hands may, and the customer/surgeon agrees, that it may amend any of the sections in its Terms and Conditions at any time and without notice. Any amendments will only be effective after publication of such amendments. In other words, the amendments will not have retroactive effect.
  1. Regulatory Compliance

Customers/surgeons shall comply with all applicable laws in connection with product pricing, Medicare, Medicaid, or any applicable federal or state health law. Additionally, customers are responsible for complying fully with any and all federal and state tax laws. Deductions for instruments, as well as any other accounting or tax implications, are completely outside the scope of the relationship between Surgeon’s Hands and its customers/surgeons. Surgeon’s Hands encourages all of its customers/surgeons to follow all applicable laws and regulations.

  1. Duty Not to Sell or Resell without Permission

Surgeon’s Hands has worked to obtain extensive and strong intellectual property rights. These intellectual property rights give Surgeon’s Hands the right to determine who may sell or distribute products containing intellectual property belonging to Surgeon’s Hands.
